Google May Be Close To Developing iTunes Competitor

Bear Stearns maintained an "outperform" rating on Google and said the Internet search giant may be looking to expand into the MP3 downloading business.

"We believe that Google is in the midst of creating its own iTunes competitor, which we've dubbed 'Google Tunes'," the analyst wrote in a client note issued today. "We think this is a logical step, now that the nascent Google Video product has been introduced."

"We would expect Google to rollout a Beta service within 3 to 6 months. We note that Google has not confirmed our expectations, and that our thinking is based on Mosaic theory," said Peck. "However, we do think this fits with Google's recent moves and its ultimate goal of organizing the world's information."

"Google Tunes" would also give Google another revenue more places to put contextually relevant and keyword ads for related products like MP3 players, concerts, t-shirts, etc. They could also cross-promote Google Tunes with Google Video. Buy a song from a certain artist and get the video OR by the video and get 20% of that artists album.

Another revenue stream might have Google allowing offering a monthly subscriptions of unlimited downloadable content and/or one for those who only want to stream music to their computers. Many services already offer these services. In fact, I'm listening to a playlist of music I created via Rhapsody as I write.

Google Wins Nevada Copyright Case

A judge found that serving pages of a story on a writer's Web site, from the Google cache, was protected under the Digital Millennium Copyright Act. This ruling could help Google with other legal issues it's facing in its bid to scan books and other copyrighted materials.

A Nevada judge has ruled in favor of Google Inc. in a copyright case that legal experts said Thursday could be helpful in its defense against lawsuits filed by writers and publishers challenging the search engine's initiative to scan and store copyrighted library books.

In addition, Google's library project offers less material than in the Field case. In the library project, Google says it would only show snippets from copyrighted books, unless it has permission to display more. In the Field case, Google displayed the whole story.

The Association of American Publishers and the Authors Guild sued Google last year, challenging the project and arguing the company needs to have permission to copy protected works. Both cases are pending.

Under the library project, Google plans to digitize books from the collections of Stanford University, Harvard University, the University of Michigan, Oxford University and the New York Public Library. The latter two are making available only books in the public domain.

Microsoft wins FAT patent

Microsoft has won its battle with the US Patents and Trademarks Office (USPTO) over its attempt to patent the File Allocation Table or FAT, which formed the basis of the management of disk storage in the days of MS-DOS.

The company applied for a patent on FAT in 1996. However, because the format had become so widely used, there were fears that Microsoft would use the FAT licence to drive out competition. A particular risk were open source projects which used FAT as a standard method of storage who feared that large royalty demands would curtail their work.

The USPTO has now reversed its earlier decision that rejected the patents in September 2004 and has upheld the patent having rejected claims by Public Patent Foundation of 'prior art' which would have rendered the application as invalid. The USPTO has also rejected two patent applications from Microsoft related to long file names in October 2005.

On its website Microsoft offers to licence the FAT IP. Pricing for this license is $0.25 per unit with a cap on total royalties of $250,000 per manufacturer. Among those who might find themselves on the receiving end of a royalty demand from Microsoft are likely to be Linux vendors and memory stick manufacturers.

Skype's first mobile phone

Well, this is the coolest thing we’ve seen so far at CES. Netgear has announced a Skype enabled mobile which serves up the ultimate in internet telephony – free calls, wherever there's a network connection.

Looking not unlike a Sony Ericsson handset, the Netgear Wi-Fi phone will bring mobile internet telephony to desk-bound Skype users the world over. No more faffing about with your PC or laptop. It’ll work wherever you connect to a wireless internet access point - be that in a home, office, cafe, or open public hotspot.

The phone’s pre-loaded with Skype’s software and ready to use the minute you rip it from the box. Just enter your Skype username and password and you’re away.

Skype may not be the first VoIP provider to offer a stand-alone Wi-Fi phone, but the mobiles mean that you will get all the freebie joy of calling fellow Skype users anywhere in the world for nowt, while still being able to call non-users for a small fee with the SkypeOut feature.

There are currently only 10 working units in existence, but news on availability will surface some time in the first quarter of 2006. All Netgear are saying about cost is that it will be 'very competitively priced'. If it means we can get rid of our landlines, we'll be there waving our credit cards regardless. Stay tuned for more info.
